Lawsuits!
Are
You in Compliance with FACTA?
Restaurants are being targeted by professional
plaintiffs for not truncating credit card
numbers and still including credit card
expiration dates. Make sure you comply
with the law.
December 4, 2006 marked the deadline for
compliance with the Fair and Accurate
Credit Transaction Act (FACTA) that deals
with truncated credit card numbers and
expiration dates printed on receipts.
Since that deadline, there have been increased
class-action lawsuits filed and many restaurants
are being targeted.
Make sure that both your internal and
customer receipts contain no more than
the last five digits of a customer's credit
card number and that they do not contain
the card's expiration date.
A
number of shakedown lawsuits have been
filed against restaurants that are not
complying with these two aspects of FACTA
specifically. In one lawsuit the CRA has
been made aware of, more than 100 businesses
are being sued for non-compliance.
